Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your use of the Hypecircle platform (the "Platform") and applies to all users, including Buyers, Promoters and Ambassadors. This Policy forms part of, and should be read alongside, the Terms of Service.

By accessing or using the Platform, you agree to comply with this Policy.

1. Purpose of this Policy

The purpose of this Policy is to ensure that the Platform is used in a lawful, fair and responsible manner and to protect the Platform, its users and the public from harm.

We may monitor use of the Platform to ensure compliance with this Policy and applicable law.

2. Prohibited Content

2.1 You must not upload, publish, transmit or otherwise make available any content on or via the Platform which:

is unlawful, illegal or promotes unlawful activity;
is fraudulent, deceptive or misleading, including any content intended to misrepresent an Event, prize or offer;
infringes or is likely to infringe any intellectual property rights or other proprietary rights of any third party;
is defamatory, libellous, threatening, abusive, harassing or invasive of another person's privacy;
promotes or incites hatred, discrimination or violence against any individual or group based on race, religion, gender, sexual orientation, disability or any protected characteristic;
contains sexually explicit material, graphic violence or any content that is harmful, exploitative or inappropriate for minors;
promotes, facilitates or relates to illegal activities, including unlawful events, unlicensed events or underage access to restricted events;
contains or distributes viruses, malware, ransomware or any other harmful or disruptive code; or
otherwise breaches any applicable law or regulation.

3. Prohibited Conduct

3.1 General Restrictions

You agree that you will not:

use the Platform in any way that breaches applicable laws or regulations;
attempt to gain unauthorised access to any part of the Platform, user accounts, systems or networks;
interfere with, disrupt or attempt to disrupt the operation, security or performance of the Platform;
use any automated system, including bots, scrapers or crawlers, to access or extract data without our prior written consent;
transmit spam, unsolicited communications or engage in bulk messaging or phishing;
collect, store or otherwise process personal data of other users without a lawful basis under applicable data protection laws;
impersonate any person or entity or misrepresent your identity or affiliation; or
use the Platform in a way that could damage, disable or overburden our infrastructure.

3.2 Additional Obligations for Promoters

If you are a Promoter, you further agree that you will not:

list, advertise or sell tickets for any Event unless you have full legal authority and all necessary licences, permissions and consents;
provide inaccurate, incomplete or misleading information about any Event, including pricing, dates, location, capacity, or age restrictions;
offer, advertise or promote prizes, rewards or incentives which you do not intend or are unable to fulfil;
fail to comply with all applicable laws and regulations, including consumer protection, health and safety, licensing and advertising laws;
misuse Buyer personal data or process such data in breach of applicable data protection laws or contractual obligations; or
engage in any conduct which may damage the reputation of the Platform or undermine trust in the marketplace.

3.3 Additional Obligations for Ambassadors

If you are participating as an Ambassador, you further agree that you will not:

purchase tickets through your own referral link or arrange for others to do so for the purpose of generating points or rewards;
create multiple accounts, use false identities or otherwise manipulate the referral system;
use bots, click farms, automated tools or artificial methods to generate traffic, clicks or sales;
make false, misleading or exaggerated claims about any Event, ticket or prize;
engage in spam, unsolicited messaging or aggressive promotional tactics;
use paid advertising in a manner that is misleading or infringes third-party rights; or
fail to clearly disclose your status as an ambassador in accordance with applicable advertising laws and guidance, including those issued by the Advertising Standards Authority (ASA) and the Competition and Markets Authority (CMA).

4. Monitoring and Enforcement

4.1 We reserve the right (but are not obliged) to monitor use of the Platform and investigate any suspected breach of this Policy.

4.2 Where we reasonably believe that a breach has occurred, we may take such action as we consider appropriate, including:

issuing a warning;
removing or disabling access to content;
suspending or restricting access to the Platform;
permanently terminating your account;
forfeiting any Ambassador points or benefits;
withholding or reversing payments where fraud or misuse is suspected;
reporting the matter to law enforcement, regulators or other authorities; and/or
taking legal action to recover any losses or damages.

4.3 We may take such action without prior notice where reasonably necessary to protect the Platform, its users or the public.

5. Reporting Violations

5.1 If you become aware of any content or conduct that breaches this Policy, you should report it to us at hello@hypecircle.vip.

5.2 We will review all reports and take action where appropriate.

6. Appeals

6.1 If you believe that action has been taken against you in error, you may appeal by contacting us within 14 days of the action.

6.2 We will review your appeal and respond within a reasonable period. Our decision shall be final.

7. Changes to this Policy

7.1 We may amend this Policy from time to time.

7.2 Where changes are material, we will provide reasonable notice. Continued use of the Platform after the effective date constitutes acceptance of the updated Policy.

8. Governing Law

This Policy is governed by the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction.
